Evicted!

Been in tears all evening, we've been given 2 months notice to leave our home. Been here 2 1/2 years. We're in debt and going to struggle!

F**k 2014! :(
 
oh nicola that is bad news is there a community law office or something similar you can go to for advice they are usually pretty good

We are getting our 2 month notice to quit soon (our landlady has sold our property). I have no way of getting a deposit together and I would need a guarantor which I can't get.

I know you say you are in debt, does that include your rent? If not, go straight to the council. As your impending homelessness is not of your doing they have a duty of care to you. You will need to take the notice, your tenancy and your rent deposit certificate.

If you do owe rent then call Shelter on 0808 800 4444 and also make an appointment to see someone at the local Citizens Advice

Thanks, we're already with step change :) and I think that may affect our credit referencing with agencies :/ This came out of the blue and we're both devastated as landlords had said a few months ago they had no intention of making a change. We love living here and it's just kinda been a last straw thing for us both after a very hard 6 months. We're totally up to date with all bills, just credit cards we couldn't handle anymore!

Sit tight and let your landlord take it to court at his expense. It will buy you a couple more months and eventually the council should help you. Its scary I know but my cousin has just been through the exact same thing.

Nicola, bad things comes in threes. Lets hope this is It for 2014 and only good things come to you now!!!

Bless you, I can relate so much to what you are saying. Having that notice hanging over you is soul destroying isn't it - especially with so much else going on too.

My landlady put this place on the market a week after I had signed a new 12 month contract so it hasn't felt like home for the past 8 months.

As your impending notice is not your fault in any way shape or form I really would say get straight down the council. Whatever they say a) try and get it in writing and b) don't react to whatever they say without getting advice first.

Before doing anything at any stage take a deep breath, have a coffee and contemplate your next move. I was 'panicked' by the council into renting a wholly unsuitable private rental but then they insisted they hadn't given me the (incorrect) information they had which is why I say take each step calmly and don't be hassled by them.

Your landlord has to give you a minimum of 2 months notice and if you can't move by then you can argue hardship and they have to go to court for an eviction order. That may only add 2-3 weeks grace but it all helps xx
 
Thanks for all your advice. I just want a quiet life to be honest! If we can find somewhere else we will get out!
 
Sorry to hear your horrid news hun. I can't offer any advice I'm afraid as I know nothing about tenancy law & as u mentioned he has given you the required amount of notice it's not illegal.

That's just so pants Nicola :( .. Hope you find somewhere soon and get settled back down again. The debt I can sympathise with:( I think we are all struggling to make ends meet at the mo but when it means keeping a roof over your head it becomes a whole different kettle of fish. (((((Hugs)))))
 
We are also getting kicked out - though it's in July. Letters from the courts and all. I'm dreading it with the deposits, etc. Costs of housing here are astronomical (plus we have to pay yearly - one check for the whole year!) and I'm petrified of what we can manage but there's no choice. We, like you, have major debt (cc) plus I still owe about $20K for my school loans. However, I know we'll find something we can afford (we can, right?) and we'll make it work. Life is all about the ebb and flow - where would the fun be if it was always easy? You'll be fine, love. Promise.
 
Sorry to hear your news, especially after the tough time with op etc. Cant offer any advise, but can sympathise. We moved into a wee cottage (renting) just over 6 months ago, it was due to be the start of a new life, hubby retire, we got a puppy, op was approaching, things were looking up, we'd been here 2 months before the bathroom was leaking badly (into next doors kitchen) we were accommodating and give our landlady time to fix, a month went past with almost unusable shower/bath then the toilet went, resulting in us having to use bucket to flush lol finally she managed to muster a new bathroom, we had to move to temporary accommodation for 2 weeks while work was done, on the Sunday before we left, i heard a dripping coming from the bedroom....... imagine my surprise to find it raining in my bedroom!!! so although were not being evicted we shall be moving soon, once we've gotten the deposits together and i'm well enough (gastric band fitted yesterday) so i understand your heartache. i echo others wisdom, get on the council list, for us it wasn't an option had to be in area for 3 years or have family here. I also got an awful lot of info on the shelter website. I wish you all the best, please try not to upset yourself, deep breaths and get well first, don't allow this to hinder your recovery. I hope a new place comes up soon...... i believe things happen for a reason so look at this as a positive move and 2014 will be a fantastic year just a tad late x x x x
 
God bless ya have you tried the Home Group in your area I work under the HOme group umberella, we are a housing association they may be able to help.
 
I have 2 properties which we let out. We did have to evict some tenants a few years back for a very very valid reason :eek:. They tried the 'stay and take me to court'. We did, even after giving them some more time to move. They lost their bond. Got a CCJ. Had to pay costs. They weren't convinced the extra 45 days in the property was worth it by the end of the ordeal. One of them also worked in a bank and then subsequently lost their job when their employer found about the CCJ. We profited from it and learnt to be totally battle hardened by the experience.

I do hasten to add we are excellent landlords and our tenants get high quality decorating, same day repairs and have 24 hour boiler call out etc etc

There's always a reason for everything.
 
They have been fine up to now and I get why they want to evict us to sell the house etc just bad timing for us! I've no plan to get courts involved.

We saw a nice place today so I have everything crossed :)
